Terms of Service

Last updated: 1 October 2026

These terms govern your use of the byteberry-analytics.com website and of the software tools operated by Byteberry Analytics (“Byteberry”, “we”, “us”), including our advertising-management tooling and the ChatPix application for Shopify. Services delivered to clients are governed by the proposal or contract signed with each client; where those documents are silent, these terms apply.

1. Who we are

Byteberry Analytics is a digital growth, data and AI agency based in the Kingdom of Saudi Arabia. Contact: hello@byteberry-analytics.com.

2. Use of the website

The content of this website is provided for information purposes. You may browse it and contact us through it. You may not copy, scrape, reverse-engineer or reuse its content, design or code without our written permission, nor use it in a way that disrupts its operation or breaches applicable law.

3. Our tools and connected accounts

Some of our tools connect to third-party platforms such as Google Ads, Google Analytics, Google Merchant Center, Meta, Microsoft Advertising and Shopify. By connecting an account you confirm that you are authorised to do so, you grant us access only for the purpose of delivering the agreed services, and you remain bound by the terms of those platforms. You can revoke access at any time from the platform's own settings. Our handling of the data accessed this way is described in our Privacy Policy.

4. Services

Our services include advertising strategy, campaign creation and management, tracking and measurement, data pipelines, automation and AI systems. Scope, fees, deliverables and duration are set out in the proposal or contract signed with each client. Advertising results depend on many factors outside our control; we commit to professional diligence, not to a guaranteed outcome.

5. Client obligations

Clients provide accurate information, timely access to the accounts and assets needed for the work, and content that complies with the law and with the policies of the advertising platforms. Clients remain responsible for their products, prices, claims and legal notices.

6. Fees and payment

Fees are those stated in the signed proposal or contract. Unless agreed otherwise, invoices are payable within 30 days. Advertising media budgets are paid by the client directly to the platforms and are never included in our fees unless expressly stated.

7. Intellectual property

We retain ownership of our methods, tools, code and know-how. Deliverables created specifically for a client are transferred to that client upon full payment, except for the underlying tools and generic components, for which the client receives a non-exclusive right of use.

8. Confidentiality

Each party keeps confidential the non-public information received from the other in the course of the relationship and uses it only for the purposes of that relationship.

9. Liability

To the extent permitted by law, our total liability for any claim arising from our website, tools or services is limited to the fees paid to us for the service concerned during the twelve months preceding the claim. We are not liable for indirect losses, loss of profit, or for decisions, outages or policy actions taken by third-party platforms.

10. Termination

Either party may end an ongoing engagement in accordance with the notice set out in the contract, or with 30 days' written notice where no notice is specified. Upon termination we revoke our access to the client's accounts and delete related data as described in our Privacy Policy.

11. Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia. The parties will seek an amicable solution before bringing any dispute to the competent courts.

12. Changes and contact

We may update these terms; the date at the top indicates the latest version. Questions can be sent to hello@byteberry-analytics.com or +966 55 383 2610.
